In Brazil, ownership of rural land is proven on paper and in the registry, not by possession or a seller’s word. Understanding how title is verified is the single most important protection an international buyer has.
The matrícula: the property’s identity document
Every registered property in Brazil has a matrícula, a unique record held at the local Real Estate Registry Office (Cartório de Registro de Imóveis). It records the property’s description and area, the chain of ownership, and any charges such as mortgages, liens, disputes or third-party rights. A current certified copy (certidão de matrícula) is the first document any serious review examines. The chain of ownership should be traced back over time to confirm it is consistent and unbroken.
Boundaries and georeferencing
For rural property, the boundaries described in the registry should correspond to a georeferenced survey certified with INCRA. Georeferencing fixes the parcel’s limits using precise coordinates, which reduces the risk of overlap with neighbouring properties, public land or protected areas. Where a parcel is not yet georeferenced, that is not necessarily fatal, but it is a step that must be understood and planned for.
Environmental registration
The CAR (Cadastro Ambiental Rural) records the property for environmental purposes, including its legal reserve and any areas of permanent preservation. It should be cross-checked against the registry and the physical parcel. Discrepancies between what is registered, what is declared environmentally, and what exists on the ground are exactly what due diligence exists to catch.
Encumbrances and disputes
A clean-looking parcel can still carry hidden problems: mortgages, judicial claims, tax debts, possession disputes, or overlapping claims. Certificates from the registry, the courts and the tax authorities help build a picture of whether the property can be transferred cleanly.
